Czech Republic
Email: hello@mhsoftworks.com
The App may be presented under the MH Softworks branding. References in these Terms to the “Developer,” “Operator,” “we,” “us,” or “our” refer to Marek Hovorka.
These Terms form a legally binding agreement between you and the Developer concerning your use of the App, subject always to any mandatory rights that cannot legally be excluded or restricted.
If you obtained the App through Google Play, Google provides the distribution and, where applicable, payment-processing platform. Google is not the developer or operator of the App and is not responsible for its content or operation except to the extent arising under Google’s own applicable terms or mandatory law.
2. Acceptance of the Terms
You should read these Terms before using the App.
By downloading, installing, purchasing functionality in, or otherwise using the App after these Terms have been made available to you, you agree to comply with them to the extent that such agreement is legally effective under applicable law.
Where applicable law requires a more specific form of consent for a particular contractual provision, purchase, waiver, permission, or other action, that specific legal requirement will apply.
If you do not agree to these Terms, you should not use the App.
Nothing in this section treats silence, inactivity, or other conduct as consent where applicable law requires express consent.
3. Eligibility
You may use the App only if you have the legal capacity required under the law applicable to you.
If you are a minor or otherwise lack full legal capacity, you may use the App or make purchases only to the extent permitted by applicable law and, where required, with authorization from a parent, guardian, or other person legally entitled to provide such authorization.
The App is not designed to create a special service for children and does not provide user accounts or social features intended for children.
4. Purpose and Scope of the App
Battery is an informational Android utility designed to display, organize, and visualize battery-related information made available by the Android operating system and the device.
Depending on the device, operating-system version, configuration, permissions, and enabled App settings, the App may display or process information such as:
- battery temperature;
- battery level;
- charging or power status;
- reported voltage;
- reported battery health;
- reported battery technology;
- reported electrical or battery properties made available by Android;
- historical temperature measurements;
- minimum, average, and maximum temperatures;
- temperature trends;
- user-configured temperature alerts;
- background battery-temperature monitoring; and
- related informational status classifications.
The App may also contain advertising and may offer a one-time purchase that removes advertising.
The App is not a diagnostic instrument, certified measuring instrument, battery-management system, safety system, device-protection system, or substitute for functionality provided by the device manufacturer or operating system.
5. License to Use the App
Subject to these Terms and applicable law, the Developer grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to install and use the App on devices that you lawfully control.
This license permits normal end-user use of the App only.
No ownership rights in the App or its underlying intellectual property are transferred to you.
Any rights not expressly granted are reserved by the Developer and the relevant third-party rights holders.
Revocation of this contractual license does not limit rights that applicable mandatory law gives you independently of these Terms.
6. Intellectual Property
To the extent owned by or licensed to the Developer, the App and its associated materials are protected by applicable intellectual-property laws.
Protected material may include, without limitation:
- source code;
- object code;
- software architecture;
- algorithms;
- interfaces;
- visual designs;
- graphics;
- icons;
- layouts;
- databases and database structures;
- text;
- documentation;
- original software components;
- branding; and
- other proprietary content.
You receive only the limited right to use the App as described in these Terms.
Nothing in these Terms claims ownership by the Developer of Android, Google Play, Google SDKs, third-party libraries, third-party advertisements, or other materials owned by third parties.
7. Third-Party Software and Licenses
The App may include, depend on, or interoperate with third-party software components and platform services.
The Google Play version of the App may use components including Google Play services, Google Mobile Ads, Google User Messaging Platform, and Google Play Billing.
Third-party components remain subject to their respective licenses, notices, terms, and intellectual-property rights.
Where an applicable open-source or third-party license grants you rights that conflict with a restriction in these Terms, the applicable third-party license governs with respect to that component.
8. Prohibited Uses
To the maximum extent permitted by applicable law, you must not:
- use the App for unlawful, fraudulent, abusive, or malicious purposes;
- use the App in a way that infringes another person’s rights;
- distribute malware or malicious code through or in connection with the App;
- attempt unauthorized access to systems, services, networks, interfaces, advertising systems, billing systems, or technical infrastructure used by the App;
- interfere with, overload, damage, disable, or disrupt the App or associated services;
- exploit vulnerabilities or security weaknesses for abusive purposes;
- manipulate advertising, impressions, clicks, rewards, billing, purchase verification, or App entitlements;
- generate artificial advertising traffic or encourage invalid interaction with advertisements;
- bypass, defeat, or interfere with payment, licensing, entitlement, advertising, consent, or security mechanisms;
- fraudulently obtain, duplicate, transfer, or retain paid functionality;
- falsely impersonate another person or misrepresent authorization to use a payment method or Google account;
- sell, sublicense, rent, commercially redistribute, or commercially exploit the App except with the Developer’s permission;
- remove or falsify proprietary notices; or
- use automated means in a manner that materially interferes with the App or associated infrastructure.
Restrictions on decompilation, reverse engineering, interoperability analysis, security research, or modification apply only to the extent permitted by applicable law. Nothing in these Terms restricts activities that mandatory law expressly permits notwithstanding contractual terms.
9. User Responsibilities
You are responsible for:
- using the App in accordance with applicable law;
- using a compatible and properly maintained device;
- maintaining appropriate device security;
- deciding whether information displayed by the App is suitable for your intended purpose;
- independently verifying information where an error could matter;
- following manufacturer instructions concerning your device and battery;
- maintaining backups where appropriate;
- maintaining control over your Google account and payment credentials;
- configuring Android permissions, notifications, background restrictions, battery optimization, and similar system settings as appropriate; and
- exercising reasonable independent judgment rather than relying exclusively on the App.
You must not assume that a missing warning, notification, status change, or abnormal reading means that the device or battery is safe or operating normally.
10. Battery Measurements and Device Data
The App primarily relies on information supplied by Android, device hardware, firmware, system broadcasts, system APIs, battery-management circuitry, and manufacturer-specific implementations.
The Developer does not independently measure the physical battery using certified external hardware.
Values displayed by the App may therefore differ from:
- the true physical condition of the battery;
- measurements obtained from calibrated equipment;
- information reported by another application;
- manufacturer diagnostic tools; or
- information generated by different firmware or operating-system versions.
Reported values may be unavailable, delayed, rounded, stale, estimated, vendor-specific, incorrectly scaled, inconsistent, or inaccurate.
Some device manufacturers may omit particular battery properties or may implement Android battery APIs differently.
The Developer does not control these upstream sources of information.
11. Temperature Classifications, Trends and Alerts
The App may classify temperature readings using labels such as “Cold,” “Normal,” “Warm,” “Hot,” or “Critical,” may calculate a temperature trend, and may allow you to configure a temperature alert threshold.
These classifications, thresholds, summaries, graphs, and trends are software interpretations intended to help present device-reported information in an understandable form.
They do not constitute a manufacturer-approved operating specification, engineering assessment, safety certification, or guarantee that a particular temperature is safe or unsafe for your specific battery, device, environment, charger, use case, or battery chemistry.
A user-configured alert is not an emergency alarm.
Alerts may fail to appear or may be delayed because of factors including:
- missing notification permission;
- notification channels being disabled;
- Android background restrictions;
- battery optimization;
- operating-system process management;
- manufacturer-specific background restrictions;
- service interruption;
- application termination;
- device restart;
- system resource pressure;
- inaccurate or unavailable battery data; or
- software defects.
You must not rely on the App as the sole means of detecting battery overheating, battery damage, electrical problems, fire risk, device malfunction, or another hazardous condition.
12. Safety, Informational Use and No Professional Advice
The App is provided as a general informational utility.
It is not designed, tested, approved, or certified as:
- professional diagnostic equipment;
- an engineering instrument;
- an electrical-safety system;
- a thermal-protection system;
- a fire-detection system;
- an occupational-safety system;
- a medical device;
- an emergency-warning system; or
- a substitute for manufacturer safety mechanisms.
Information displayed by the App does not constitute engineering, electrical, technical, medical, or other professional advice.
If a device appears damaged, swollen, excessively hot, emits unusual odors, smokes, behaves abnormally, or otherwise presents a potential hazard, follow appropriate manufacturer and safety instructions rather than waiting for or relying on an App reading or notification.
The App does not override or control the device’s battery-management hardware or operating-system safety systems.
13. Application Availability
The Developer does not guarantee that the App will be continuously available, uninterrupted, secure, or error-free.
Operation may be affected by:
- maintenance;
- defects or bugs;
- operating-system updates;
- manufacturer changes;
- changes to Android APIs;
- Google Play changes;
- changes to third-party SDKs;
- billing or advertising service outages;
- network failures;
- device-specific behavior;
- storage or database corruption;
- permission changes;
- security measures; or
- events outside the Developer’s reasonable control.
No service-level agreement or uptime guarantee is created by these Terms.
14. Compatibility
The App is designed for supported Android environments, but compatibility with every device, firmware build, manufacturer customization, display configuration, regional configuration, Google Play configuration, or future Android version is not guaranteed.
Features may behave differently or may be unavailable on particular devices.
Compatibility may depend on hardware capabilities, Android APIs, permissions, background-execution rules, Google Play services, notification settings, network access, and third-party services.
Statements about compatibility do not create a guarantee beyond any rights that cannot lawfully be excluded.
15. Updates and Changes to the App
The Developer may, where legally permissible, update, modify, redesign, replace, improve, limit, remove, suspend, or add App features.
Changes may be made for reasons including:
- security;
- reliability;
- compatibility;
- legal compliance;
- Google Play requirements;
- changes to Android;
- third-party service changes;
- performance;
- user experience;
- maintenance; or
- product development.
Where mandatory law governing paid digital content requires updates, conformity, notice, continued functionality, or other remedies, those mandatory obligations remain unaffected.
The Developer does not promise that every current free feature will remain available indefinitely.
Material changes affecting a paid entitlement will be handled subject to applicable law.
16. Third-Party Services and External Links
The App may interact with or link to third-party services, including Google Play, Google advertising services, consent-management services, payment infrastructure, websites, and other Android platform functionality.
Third-party services are operated independently from the Developer.
Their availability, functionality, terms, policies, data practices, and technical behavior may change without the Developer’s control.
The Developer is not responsible for third-party content or conduct merely because the App displays a link, advertisement, integration, or interface associated with a third party.
This does not exclude responsibility that applicable law expressly places on the Developer.
When you leave the App or interact directly with a third party, that third party’s terms and privacy practices may apply.
17. Advertising
The Google Play version of the App may display third-party advertising.
Advertising formats may include, where enabled and available:
- banner advertising;
- interstitial advertising;
- app-open advertising;
- rewarded advertising; and
- rewarded-interstitial advertising.
Advertising availability, format, frequency, content, and relevance may vary.
The display of an advertisement does not by itself mean that the Developer endorses the advertiser, advertisement, product, service, claim, website, or transaction.
Third-party advertisers are responsible for their own advertising content to the extent provided by applicable law.
Advertising must not be manipulated, fraudulently triggered, repeatedly refreshed for artificial impressions, or otherwise abused.
Some advertising depends on network connectivity, consent status, geographic region, inventory, Google services, and advertising-system eligibility.
18. Rewarded Advertising and Temporary Ad-Free Access
The App may allow users to voluntarily interact with rewarded advertising in exchange for a temporary period without advertisements.
At the effective date of these Terms, the App is designed to offer a temporary ad-free period of approximately 30 minutes after successful completion of the applicable rewarded advertising flow.
This temporary benefit:
- is not a purchase;
- is not transferable;
- is not redeemable for money;
- does not create a permanent entitlement;
- may require successful completion of an eligible advertisement;
- may be unavailable when advertising inventory is unavailable; and
- expires automatically.
The App may use device timing mechanisms to calculate the remaining temporary entitlement.
Closing the App, restarting the device, changing operating-system behavior, or other technical events may affect the practical operation of a temporary reward. The Developer is not required to convert temporary rewarded access into a permanent entitlement.
19. One-Time “Remove Ads” Purchase
The Google Play version of the App may offer a one-time, non-recurring in-app purchase that removes advertising from the App.
This purchase is intended to be a non-consumable digital entitlement associated with the applicable Google Play purchase environment.
It is not a subscription and does not automatically renew.
The current price, applicable taxes, currency, and payment information are shown by Google Play before purchase and may vary by country or other factors.
The purchase removes advertising functionality covered by the entitlement. It does not constitute a purchase of ownership of the App, source code, intellectual property, future unrelated products, third-party services, or any separately offered future product unless expressly stated.
20. Google Play Billing, Purchase Verification and Restoration
Purchases offered within the Google Play version of the App are processed through Google Play Billing where required by Google Play rules.
Google Play may determine payment methods, currency handling, transaction processing, authentication, order records, and other payment-platform functions.
The App may verify that the relevant remove_ads product is in a valid purchased state before enabling the entitlement.
Purchase verification may rely on Google Play purchase information and, where configured by the Developer, may also involve a secure verification service.
A purchase may need to be acknowledged or otherwise processed as required by Google Play.
Temporary network failures, Google Play outages, verification failures, account changes, incomplete transactions, pending transactions, refunds, revocations, or other billing events may temporarily prevent an entitlement from being recognized.
The App may provide a function to restore or re-check an existing purchase.
Restoration requires the relevant Google Play environment and does not guarantee restoration of an entitlement that has been refunded, revoked, cancelled, invalidated, associated with a different account, or otherwise no longer recognized as purchased.
The Developer may take reasonable measures to prevent fraudulent or duplicated entitlements.
21. Refunds, Withdrawal Rights and Statutory Digital-Content Remedies
Nothing in these Terms removes or restricts any refund, withdrawal, conformity, repair, price-reduction, termination, reimbursement, or other remedy that you are entitled to under mandatory applicable law.
Google Play may provide its own mechanisms for requesting or processing refunds.
Where the Developer is legally responsible for a remedy, the existence of a Google Play payment mechanism does not remove that responsibility.
For consumers in the European Economic Area and other jurisdictions providing a statutory withdrawal right for remotely supplied digital content, the existence and loss of that right are governed by mandatory law.
Where applicable law permits the withdrawal right to be lost after immediate supply of digital content, that loss applies only if the legal requirements for doing so have actually been satisfied, including any required prior express consent, acknowledgement, or contractual confirmation.
These Terms do not treat the mere existence of this clause as satisfying such requirements.
Mandatory statutory rights relating to conformity of digital content, required updates, remedies for lack of conformity, or failure to supply remain unaffected.
No provision of these Terms means “no refunds under any circumstances.”
22. Privacy
Processing of personal data associated with the App is described in the separate Privacy Policy made available through the App or the Developer’s website.
These Terms do not replace the Privacy Policy.
The App’s own measurement history and preferences are designed to be stored primarily in private application storage on the device.
The Google Play version may use third-party Google services for advertising, consent management, and billing, which may process information independently or on behalf of relevant parties according to their applicable terms and privacy documentation.
Where a purchase-verification service is configured, information necessary to verify a purchase may be transmitted to that service.
Privacy rights provided by applicable data-protection law remain unaffected by these Terms.
23. Local Storage, Measurement History and Data Loss
The App may store battery measurement history, session information, settings, entitlement-related state, and other App data locally on the device.
The App is not a backup service.
Local data may be lost, reset, corrupted, or become inaccessible as a result of circumstances including:
- uninstalling the App;
- clearing App data;
- device reset;
- storage corruption;
- operating-system behavior;
- device failure;
- software defects;
- database failure;
- application updates;
- security software;
- manufacturer tools; or
- other events outside the Developer’s reasonable control.
Starting a new measurement is designed to start a new current measurement session and does not necessarily delete previously stored historical data.
Where the App provides an explicit history-deletion or settings-reset function, use of that function may permanently remove the relevant local data.
You are responsible for maintaining any backups that are important to you where backup functionality is technically available outside the App.
24. Disclaimer of Warranties
This section applies only to the maximum extent permitted by applicable law and does not affect statutory rights that cannot legally be excluded.
Subject to those mandatory rights, the App is provided on an “as available” basis.
The Developer does not warrant that the App will:
- always be available;
- be completely error-free;
- operate without interruption;
- display perfectly accurate battery information;
- detect every unsafe condition;
- provide notifications at any guaranteed time;
- work on every device;
- remain compatible with every future Android version;
- satisfy every particular purpose;
- prevent battery damage;
- prevent device damage;
- prevent data loss; or
- remain unaffected by third-party service changes.
No informational temperature classification or alert constitutes a warranty regarding the condition, lifespan, safety, capacity, performance, or remaining useful life of a battery.
Nothing in this section excludes any statutory guarantee, conformity obligation, or remedy that cannot legally be excluded.
25. Limitation of Liability
25.1 Mandatory rights preserved
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, these Terms do not exclude liability that cannot lawfully be excluded for matters such as intentional misconduct, liability that mandatory consumer law preserves, or any other protected category under applicable law.
25.2 General limitation
To the maximum extent permitted by applicable law, the Developer will not be liable for losses that are not a reasonably foreseeable consequence of a breach attributable to the Developer.
To the maximum extent permitted by applicable law, the Developer is not responsible for loss or damage caused solely or primarily by:
- inaccurate information supplied by Android, hardware, firmware, or the device manufacturer;
- a user’s reliance on the App as a certified safety or diagnostic system;
- failure to follow device-manufacturer instructions;
- notification permission or notification-channel settings;
- Android or manufacturer background-process restrictions;
- network failure;
- third-party advertising or billing outages;
- Google Play failure;
- incompatibility outside the Developer’s reasonable control;
- unauthorized modification of the App or device;
- rooted, compromised, maliciously modified, or unsupported environments;
- user misuse;
- fraudulent use;
- failure to maintain reasonable device security; or
- circumstances outside the Developer’s reasonable control.
25.3 Indirect and commercial losses
Where permitted by law, the Developer is not liable for indirect, incidental, special, or consequential loss, or for loss of profit, revenue, opportunity, business, goodwill, or business data arising from use of the App.
This limitation is particularly intended to apply where the App is used for business, professional, commercial, laboratory, repair, engineering, testing, or other non-consumer purposes for which the App was not specifically designed.
25.4 Business and professional users
If you use the App wholly or mainly in the course of a trade, business, craft, or profession, then, to the maximum extent permitted by law and except for liability that cannot legally be limited, the Developer’s aggregate contractual liability arising from the App will not exceed the total amount actually paid by you to the Developer through the applicable App purchase associated with the claim.
This contractual cap does not apply where applicable law renders such a limitation ineffective.
25.5 Consumers
If you are a consumer, the limitations in this section apply only insofar as they are fair, transparent, and legally effective under the mandatory consumer law applicable to you.
Your non-waivable statutory rights remain unaffected.
26. User Misuse and Indemnification
You are responsible for losses directly caused by your own unlawful, fraudulent, malicious, or intentionally abusive conduct to the extent provided by applicable law.
If you use the App in the course of a trade, business, craft, or profession, you agree, to the extent permitted by law, to indemnify the Developer against reasonable third-party claims, losses, and expenses arising directly from:
- your unlawful use of the App;
- deliberate abuse of advertising or billing systems;
- infringement caused by material you introduce or distribute;
- unauthorized redistribution of the App; or
- intentional interference with associated systems.
No broader consumer indemnity is imposed where it would be unfair or unenforceable under applicable consumer law.
27. Suspension and Termination
The App does not require a Developer-operated user account.
Nevertheless, to the extent technically and legally possible, the Developer may take proportionate measures to protect the App, associated services, advertising systems, billing systems, and intellectual property against:
- fraud;
- security attacks;
- malicious interference;
- unlawful conduct;
- serious abuse;
- manipulated purchases;
- invalid entitlements; or
- material violations of these Terms.
The contractual license granted under these Terms may terminate in the case of a serious breach, subject to applicable law.
Termination does not remove rights already accrued under mandatory consumer law and does not permit the Developer to arbitrarily confiscate a legally valid paid entitlement contrary to applicable law.
28. Discontinuation of the App
The Developer may decide to stop developing, distributing, or supporting the App where legally permissible.
Reasons may include technical, security, commercial, legal, platform, compatibility, or third-party-service changes.
The Developer does not promise indefinite availability, indefinite updates, or support for future Android versions.
Any discontinuation affecting a paid digital entitlement remains subject to mandatory applicable consumer law, including any rights concerning conformity, updates, contractual performance, refunds, price reductions, or termination that cannot be waived.
29. Changes to These Terms
The Developer may update these Terms where reasonably necessary, including for:
- legal or regulatory changes;
- App functionality changes;
- security;
- Google Play requirements;
- changes in third-party services;
- corrections or clarifications; or
- legitimate product changes.
Purely editorial or non-material changes may take effect when published.
Where a change materially affects an existing contractual relationship and applicable law requires notice, consent, a valid contractual reason, a right to terminate, or another safeguard, the required safeguard will be provided.
A material change does not become binding on a consumer merely because it was silently published if mandatory law requires more.
The version identified by its effective date applies subject to these rules.
30. Force Majeure
To the maximum extent permitted by law, the Developer will not be responsible for delay or failure caused by events outside the Developer’s reasonable control, such as:
- natural disasters;
- fire;
- war;
- terrorism;
- civil unrest;
- governmental measures;
- widespread power failure;
- telecommunications outages;
- major cloud or platform outages;
- cyberattacks by third parties;
- widespread Google or Android service failures;
- strikes;
- epidemics or pandemics; or
- comparable extraordinary events.
This section does not eliminate obligations that mandatory law requires the Developer to perform despite such an event.
31. Governing Law
These Terms and the contractual relationship concerning the App are governed by the laws of the Czech Republic, without prejudice to applicable conflict-of-laws rules.
If you are a consumer and mandatory law provides that you benefit from non-derogable consumer protections of the country of your habitual residence, the choice of Czech law does not deprive you of those protections.
Nothing in these Terms is intended to avoid mandatory law that applies irrespective of contractual choice.
32. Jurisdiction
Nothing in these Terms requires a consumer to bring proceedings exclusively before a Czech court where applicable mandatory law gives that consumer the right to bring proceedings elsewhere.
Consumers retain any mandatory jurisdiction rights provided by applicable national or European Union law.
For users acting exclusively in the course of a trade, business, craft, or profession, disputes may, to the extent legally permitted, be submitted to the competent courts of the Czech Republic.
Any contractual choice of forum applies only to the extent legally effective.
33. Consumer Rights and Alternative Dispute Resolution
If you are a consumer, your mandatory statutory consumer rights are unaffected by these Terms.
You are encouraged to contact the Developer first at hello@mhsoftworks.com so that an issue can be investigated and, where possible, resolved directly.
Where the Developer and a consumer fail to resolve a consumer dispute directly and the Czech statutory ADR regime applies, the competent general alternative dispute resolution entity is:
Czech Trade Inspection Authority (Česká obchodní inspekce / ČOI)
The availability, competence, procedure, and conditions of ADR are determined by applicable law.
The former European Union Online Dispute Resolution (ODR) Platform is not identified in these Terms because that platform has been discontinued.
Nothing in this section prevents either party from exercising rights before a competent court or another legally competent body.
34. Severability
If any provision of these Terms is found invalid, unlawful, unfair, or unenforceable, that provision will apply only to the maximum extent legally permissible.
Where legally possible, the remaining provisions will continue in effect.
This section does not authorize rewriting an invalid consumer term in a way that would deprive a consumer of mandatory protection.
35. No Waiver
A failure or delay by the Developer in exercising a right or enforcing a provision does not automatically waive that right or provision.
A waiver concerning one event does not automatically constitute a waiver concerning another event.
This section applies only to the extent permitted by applicable law.
36. Assignment and Entire Agreement
36.1 Assignment
To the extent permitted by applicable law, the Developer may transfer rights or obligations connected with the App as part of a legitimate sale, transfer, succession, restructuring, or transfer of the relevant product or business activity.
Any transfer affecting consumers remains subject to mandatory consumer protections and may not materially reduce a consumer’s contractual rights contrary to applicable law.
You may not transfer a personal App license or paid entitlement except where the applicable Google Play system or mandatory law expressly permits it.
36.2 Entire Agreement
These Terms, together with any documents expressly incorporated into them and any mandatory terms applicable to a specific Google Play transaction, govern your use of the App.
The Privacy Policy separately governs relevant personal-data processing.
Nothing in this Entire Agreement clause excludes legally binding representations, rights, or remedies that cannot lawfully be excluded.
37. Language
These Terms are originally prepared in English.
Translations may be provided for convenience.
Where legally permissible, the English version is used to interpret differences between translations.
However, the English version does not override mandatory language requirements, consumer protections, or rules of interpretation that applicable law requires in a consumer’s jurisdiction.
